Prosper & Bloom Mental Health, Inc. (“Prosper & Bloom,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, share, and protect information gathered through our website at prosper-bloom.com and any related pages, landing pages, forms, or online advertising we operate (together, the “Site”).
This policy covers our website — not your medical record. If you are a patient of Prosper & Bloom Mental Health, Inc., the health information we create and maintain about your care is protected health information (“PHI”) governed by the Health Insurance Portability and Accountability Act (“HIPAA”). How we may use and disclose that information, and the rights you have over it, are described in our separate Notice of Privacy Practices, which controls over this policy for any conflict involving PHI.
By using the Site, you agree to this Privacy Policy and to our Terms of Use.
2. Information We Collect
2.1 Information you give us directly
We collect information you choose to submit, including through contact forms, appointment or consultation request forms, intake or interest forms, newsletter signups, and email or phone communications. This may include:
- Name, email address, telephone number, and mailing or city/state location
- The reason you are reaching out, your availability, and any details you volunteer about what you are looking for
- For parents or guardians inquiring on behalf of a student: your name and contact details, and the student’s first name and general situation
- Insurance carrier or payment interest, if you tell us
- Any other information you choose to include in a free-text message field
Please do not submit detailed health information through website forms or general email. Website forms and standard email are not secure channels. Share only what is needed to
schedule or ask a question; clinical detail belongs in our secure patient portal, in our secure messaging platform, or in your appointment.
2.2 Information collected automatically
When you visit the Site, certain information is collected automatically by our hosting provider, analytics tools, and advertising tools:
- IP address and approximate geographic region derived from it
- Browser type, operating system, device type, and screen size
- Pages viewed, links clicked, time spent on pages, scroll depth, and referring website or ad
- Date and time of your visit
- Cookie identifiers and similar device identifiers
2.3 Cookies and similar technologies
We use cookies, pixels, tags, and similar technologies for the following purposes:
- Strictly necessary: to make the Site load, keep pages functioning, and secure our forms
- Analytics: to understand how visitors find and use the Site so we can improve it
- Advertising and measurement: to measure the performance of our advertising and, in some cases, to show our ads to people who previously visited the Site
You can control cookies through your browser settings. Blocking all cookies may cause parts of the Site to stop working. Most browsers also offer a “Do Not Track” setting; because there is no common industry standard for how to respond to those signals, we do not currently respond to them, though we do honor Global Privacy Control signals where legally required.
2.4 Information we do not want you to send
Please do not send us Social Security numbers, financial account numbers, photographs of insurance cards, or copies of government identification through website forms or unencrypted email. If you need to provide those, we will give you a secure method.
We use the information described above to:
- Respond to your inquiry and schedule appointments, consultations, or coaching sessions
- Verify eligibility for services
- Provide, operate, maintain, secure, and improve the Site
- Measure which pages, ads, and referral sources bring people to us, in aggregate
- Send you information you requested, such as a newsletter, resource, or appointment reminder
- Detect, investigate, and prevent fraud, abuse, spam, or security incidents
- Comply with legal, regulatory, licensing, and professional obligations
We do not use information collected through the Site to make automated decisions that produce legal or similarly significant effects about you.
4. How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising in a way that would constitute a “sale” or “share” under state privacy laws.
We share information only as follows:
Service providers and vendors. We use third parties to run our website, communications, scheduling, records, billing, and payment operations. Examples of the categories we use include website hosting, email and secure messaging, electronic health records and the patient portal, e-prescribing, telehealth, payment processing, insurance clearinghouses, analytics, and advertising platforms. Vendors that create, receive, maintain, or transmit PHI on our behalf are bound by written Business Associate Agreements as required by HIPAA, and all vendors are limited to using information for the services they provide to us.
Insurance and payment. If you become a patient and use insurance, we share the information necessary to verify benefits, obtain authorizations, and submit claims.
Professional and legal obligations. We may disclose information when required by law, regulation, subpoena, court order, or lawful government request, or when necessary to establish or defend legal claims, protect our rights, or address safety concerns as permitted by law and professional standards.
Business transitions. If Prosper & Bloom is involved in a merger, acquisition, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to the protections described in this policy and applicable health privacy law.
With your direction. We share information when you ask us to or authorize us to.
5. Advertising and Analytics
We advertise our services online, including through search advertising. Advertising and analytics providers may set cookies or use pixels on the Site to measure ad performance and to help us reach people who may be interested in our services.
We take specific care with health-related advertising:
- We do not provide advertising platforms with your name, email, phone number, diagnosis, or the contents of anything you submit through a form.
- We do not build or use advertising audiences based on a health condition, diagnosis, symptom, or treatment.
- Our advertising campaigns and landing pages are written to be condition-neutral.
If you would prefer to limit interest-based advertising generally, you can use the industry opt-out tools at optout.aboutads.info and optout.networkadvertising.org, and adjust the ad settings offered by your browser, device, and Google account.
6. Children’s Privacy
The Site is intended for adults. We do not knowingly collect personal information online from children under 13, and children under 13 should not submit information through the Site.
Some of our services — including executive function coaching — may be provided to students who are under 18. When a person under 18 receives services, enrollment, consent, and payment are handled through a parent or legal guardian, and the associated information is collected through our intake process rather than through open website forms. If you believe a child has submitted information to us through the Site, contact us at contact@prosper-bloom.com and we will delete it.
7. Your Privacy Choices and Rights
Regardless of where you live, you may:
- Ask us what personal information we hold about you from Site interactions
- Ask us to correct inaccurate information
- Ask us to delete information collected through the Site, subject to our legal and professional record-retention obligations
- Unsubscribe from marketing email by using the unsubscribe link in any message, or by contacting us
- Opt out of text messages by replying STOP to any text from us
If you are a patient, your rights over your medical record come from HIPAA and applicable state law, not from this policy. Those rights — including access, amendment, accounting of disclosures, restrictions, and confidential communications — are described in our Notice of Privacy Practices. Deletion rights under consumer privacy laws generally do not apply to information in a designated record set, which we are required to retain.
Additional rights under applicable privacy laws. Depending on the law that applies to you, you may have additional rights to know, access, correct, delete, or limit certain processing of your personal information, and to appeal a denial of a request. Information regulated by HIPAA is generally exempt from those laws. To exercise a right, contact us using the details in Section 11. We will verify your identity before responding and will not discriminate against you for exercising a right.
Consumer health data. Where a law applies to health-related information we collect outside of HIPAA through the Site, we collect it only to respond to you and to operate the Site, we do not sell it, and you may contact us to access or delete it.
8. Data Security
We maintain administrative, technical, and physical safeguards designed to protect the information we hold. These include role-based access controls, multi-factor authentication on systems that hold sensitive information, full-disk encryption on devices used for our work, encrypted transmission of data, a virtual private network for remote staff, written device and
data-handling policies, workforce privacy and security training, and written agreements with the vendors who handle information on our behalf.
No method of transmission or storage is completely secure. Email and website forms in particular are not secure channels, and we cannot guarantee the security of information you send us that way.
9. Data Retention
We keep information only as long as needed for the purposes described here, or longer where required by law or professional standards. Inquiry and marketing information is generally retained for a limited period and then deleted or de-identified. Patient records are retained for the period required by Louisiana law, applicable licensing boards, and payer requirements.
10. Links to Other Sites
The Site may link to third-party websites, including our patient portal, payment pages, scheduling tools, and educational resources. Those sites are governed by their own privacy policies, and we are not responsible for their content or practices. We encourage you to read the privacy policy of any site you visit.
